Burgwyn was appointed a Confederate officer on the recommendation of his VMI professor, Thomas J. "Stonewall" Jackson, he was killed when his 26th North Carolina engaged the Iron Brigade in Herbst's Woods on July 1, 1863, at Gettysburg, Burgwyn was shot through both lungs while carrying the colors of the 26th, he was 21 years old
